These Terms of Service ("Terms") govern your access to and use of Aspirant Sarthi ("Service," "we," "our," or "us") operated at aspirantsarthi.com and app.aspirantsarthi.com. By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Acceptance of Terms
By accessing or using Aspirant Sarthi, you confirm that:
- You are at least 15 years of age.
- You have the legal capacity to enter into a binding agreement.
- You have read, understood, and agree to these Terms and our Privacy Policy.
- Your use of the Service complies with all applicable laws and regulations in your jurisdiction.
2. Description of Service
Aspirant Sarthi is a free educational platform that provides:
- Daily study goal tracking and progress analytics.
- Study group creation and management with peer accountability features.
- Mains answer writing practice with image upload and group sharing.
- Group chat, polls, and collective daily target setting.
- Monthly target tracking and performance history.
We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice.
3. User Accounts
3.1 Registration
You must create an account to access most features. You agree to provide accurate, complete, and current information and to keep your account information updated.
3.2 Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately at support@aspirantsarthi.com of any unauthorised use.
3.3 One Account Per Person
Each user may maintain only one account. Creating multiple accounts to circumvent restrictions or bans is prohibited.
4. User Conduct
You agree not to:
- Post content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable.
- Share copyrighted material without proper authorisation.
- Impersonate any person or entity, or falsely claim an affiliation.
- Upload content containing malware, viruses, or any malicious code.
- Attempt to gain unauthorised access to other accounts or the Service's backend systems.
- Use the Service to spam, phish, or conduct any fraudulent activity.
- Scrape, crawl, or use automated means to access the Service without our written permission.
- Use the Service for any commercial purpose without our explicit written consent.
- Upload answer writing images that contain content violating any of the above prohibitions.
5. User Content
5.1 Your Content
You retain ownership of any content you submit to the Service ("User Content"), including study notes, targets, answer writing images, and chat messages.
5.2 License to Us
By submitting User Content, you grant Aspirant Sarthi a non-exclusive, royalty-free, worldwide license to use, display, and distribute your content solely for the purpose of providing and improving the Service.
5.3 Content Responsibility
You are solely responsible for your User Content. We do not endorse or verify User Content and are not liable for any content submitted by users.
5.4 Content Removal
We reserve the right to remove any User Content that violates these Terms or that we determine, in our sole discretion, to be inappropriate.
6. Study Groups
When participating in study groups:
- Group admins are responsible for maintaining appropriate standards within their groups.
- Members share responsibility for the group environment.
- Joining a group constitutes consent to view other members' shared progress and targets.
- Group admins may remove members at their discretion.
7. Intellectual Property
The Service and its original content (excluding User Content), features, and functionality are owned by Aspirant Sarthi and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our written permission.
8. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
We do not warrant that:
- The Service will be uninterrupted, error-free, or completely secure.
- The results obtained from using the Service will be accurate or reliable.
- Use of the Service will guarantee success in any examination.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ASPIRANT SARTHI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, REVENUE, OR PROFITS, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.
10. Indemnification
You agree to defend, indemnify, and hold harmless Aspirant Sarthi and its officers, directors, employees, and agents from any claims, damages, obligations, losses, liabilities, costs, or debt arising from your use of the Service or violation of these Terms.
11. Termination
We may terminate or suspend your account and access to the Service immediately, without prior notice, for conduct that we determine violates these Terms or is harmful to other users, us, third parties, or for any other reason at our discretion.
Upon termination, your right to use the Service ceases immediately. You may request deletion of your data by emailing support@aspirantsarthi.com.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of India.
13. Changes to Terms
We reserve the right to modify these Terms at any time. We will provide notice of significant changes by updating the "Last updated" date. Continued use of the Service after changes constitutes acceptance of the revised Terms.
